Terms of Service

1. Agreement to Terms

By accessing or using Crifter, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the service.

2. Description of Service

Crifter is an AI-powered creature collector app. Users upload photos of their environment, and our service uses artificial intelligence to generate unique creatures ("Crifters") based on visual patterns in those photos. Each creature generation requires credits.

3. Eligibility

You must be at least 13 years old to use Crifter. By using the service, you represent and warrant that you meet this age requirement. If you are under 18, you should review these terms with a parent or guardian.

4. User Accounts

When you create an account with us, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Not share your account with others
• Notify us immediately of any unauthorized access

You may only maintain one account per person. We reserve the right to suspend or terminate duplicate accounts.

5. Credits and Payments

• Credits are required to generate Crifters (5 credits per generation)
• Credits can be purchased directly or obtained through subscriptions
• All purchases are final and non-refundable
• Unused credits do not expire while your account remains active
• Credits have no cash value and cannot be transferred or sold

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. User Content

When you upload photos to Crifter:

• You retain full ownership of your original photos
• You grant Crifter a non-exclusive, worldwide license to process your photos solely for the purpose of providing the service
• You represent that you have the right to upload the content and that it does not infringe on any third-party rights

You must not upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

7. AI-Generated Content (Crifters)

Regarding the creatures generated from your photos:

• You own the Crifters generated from your uploaded photos
• You grant Crifter a non-exclusive, royalty-free license to use, display, and showcase your Crifters for promotional and marketing purposes
• Crifters are for personal, non-commercial use only
• You may not sell, trade, or commercially exploit your Crifters

8. Acceptable Use

You agree not to:

• Upload content that infringes intellectual property rights
• Upload illegal, harmful, or offensive content
• Attempt to reverse engineer the AI or service
• Use automated tools, bots, or scrapers to access the service
• Circumvent security measures or credit systems
• Interfere with or disrupt the service or servers
• Use the service for any unlawful purpose
• Impersonate any person or entity

9. Intellectual Property

The Crifter service, including its name, logo, design, features, functionality, and underlying technology, is owned by Crifter and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the service itself.

10. Termination

• You may delete your account at any time through the settings page
• We may suspend or terminate your account for violations of these Terms
• Upon termination, your right to use the service ceases immediately
• Any unused credits will be forfeited upon account termination
• We may retain certain data as required by law or for legitimate business purposes

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee:

• Continuous or error-free operation of the service
• The quality or accuracy of AI-generated content
• That the service will meet your specific requirements

We are not responsible for any issues arising from third-party services, including Google Sign-In and Google Gemini AI.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRIFTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Crifter from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your content, or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Bulgaria.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through an in-app notice. Your continued use of the service after such modifications constitutes your acceptance of the updated Terms.
